Terms of Service

1. Acceptance

By accessing AIGate ("Service") you agree to these Terms. If you disagree, do not use the Service. AIGate is operated by the Melyx ecosystem.

2. Service Description

AIGate provides a unified API for AI-powered image and video generation, a shared asset library, smart routing, and related developer tools. The Service is offered on a credit-based one-time purchase model.

3. Account Registration

• You must provide a valid email address.
• You are responsible for keeping your API key confidential.
• One account per person. Automated account creation (bots) is prohibited.
• You must be at least 18 years old to purchase paid plans.

4. Credits and Payment

• Credits are purchased one-time and do not expire.
• Credits are non-refundable once consumed.
• Unused credits from a plan purchase may be refunded within 7 days if no credits have been used.
• Prices are in USD and may change with 14 days' notice.

5. Acceptable Use

You may not use AIGate to generate:

• Content depicting minors in any sexual context (strictly prohibited, results in immediate ban).
• Non-consensual intimate imagery (NCII).
• Content that violates applicable laws in your jurisdiction.
• Spam, phishing, or deceptive materials targeting individuals.
• Content designed to spread disinformation or manipulate elections.

Content mode restrictions are enforced per tier. Unlocking higher content modes via BYOK (Bring Your Own Key) still requires compliance with these Terms and your key provider's policies.

6. API Rate Limits and Fair Use

• Free tier: up to 20 API calls per day.
• Paid tiers: as specified in the plan description.
• Automated abuse or attempts to bypass rate limits will result in suspension.

7. Intellectual Property

Images and videos generated via AIGate using system credits are licensed to you for commercial use. Attribution is not required. AIGate retains the right to add generated assets to the shared library (anonymized, no personal data).

Assets generated via your own BYOK keys are subject to your key provider's licensing terms.

8. Warranty Disclaimer

The Service is provided "as is" without warranty of any kind. AI generation results are non-deterministic; we do not guarantee specific outputs, quality, or accuracy.

9. Limitation of Liability

AIGate's total liability to you shall not exceed the amount you paid for the Service in the 30 days preceding the claim. We are not liable for indirect, incidental, or consequential damages.

10. Termination

We may suspend or terminate accounts that violate these Terms. Serious violations (CSAM, illegal content) are reported to relevant authorities.

11. Changes to Terms

We may update these Terms. Significant changes will be communicated via email to registered users. Continued use after the effective date constitutes acceptance.
